McAdoo’s Seafood & La Cosecha Mexican Table
Case Information
Our firm filed a lawsuit on behalf of a group of servers and bartenders who worked for McAdoo’s Seafood and La Cosecha Mexican Table. The lawsuit alleges that McAdoo’s Seafood and La Cosecha violated the Fair Labor Standards Act—the federal law governing the payment of wages and tips to tipped employees.
More specifically, the lawsuit alleges that McAdoo’s Seafood and La Cosecha unlawfully: (1) failed to provide notice of all information required by federal law; (2) required their servers and bartenders to pay for business expenses, uniforms, and other items; (3) took their servers’ tips from the tip pool to cover the hourly wages of other employees who McAdoo’s Seafood and La Cosecha were legally required to pay from their own pocket; (4) paid their servers and bartenders the subminimum hourly rate to perform non-tipped tasks that were both related and unrelated to their occupations as servers.
You are eligible to join this lawsuit if:
- You were (or are) employed by McAdoo’s Seafood and/or La Cosecha in the last three years; and
- You were paid a direct subminimum (i.e. $2.13) hourly wage (prior to accounting for tips)
Federal law prohibits McAdoo’s Seafood, La Cosecha, or anyone else from discriminating or retaliating against you for exercising your legal rights, including exercising your legal right to join this lawsuit.
Status Updates

January 2, 2024 – The Court granted Plaintiffs’ request and ordered that servers & bartenders who work and worked at McAdoo’s Seafood and La Cosecha Mexican Table be notified of their right join this lawsuit and seek recovery of unpaid wages and other damages.
September 29, 2023 – Plaintiffs filed a motion asking the Court to notify all servers & bartenders who worked at McAdoo’s Seafood and La Cosecha Mexican Table of their right to join this lawsuit and seek recovery of unpaid wages and other damages.
