Dakota’s Steakhouse

Case Information

Our firm filed a lawsuit on behalf of a group of servers who worked for 600 North Akard, LLC doing business as Dakota’s Steakhouse. The lawsuit alleges that Dakota’s Steakhouse violated the Fair Labor Standards Act—the federal law governing the payment of wages and tips to tipped employees.

More specifically, the lawsuit alleges that Dakota’s Steakhouse unlawfully: (1) failed to provide notice of all information required by federal law; (2) required servers to pay for business expenses, uniforms, and other items; (3) taking the servers’ tips from the tip pool to cover the hourly wages of other employees who Dakota’s Steakhouse was legally required to pay from its own pocket; (4) paid servers the subminimum hourly rate to perform non-tipped tasks that were both related and unrelated to their occupations as servers.

You are eligible to join this lawsuit if:

  • You were (or are) employed by Dakota’s Steakhouse as a server or bartender in the last three years; and
  • You were paid a direct subminimum (i.e. $2.13) hourly wage (prior to accounting for tips)

Federal law prohibits Dakota’s Steakhouse or anyone else from discriminating or retaliating against you for exercising your legal rights, including exercising your legal right to join this lawsuit.
